The company MATHEYSINE PARAPENTE, with its registered office at 60 CHEMIN DU PLÂTRE, 38220 SAINT JEAN DE VAULX, registered under SIREN: 824192082 and SIRET: 82419208200025, is represented by Mr. CHENEVAS-PAULE LAURENT, having full powers for the purposes hereof.
These general conditions apply to any purchase, use, or refund of any product and/or service offered by MATHEYSINE PARAPENTE (notably paragliding services and gift vouchers), as well as any reservation made via the website https://matheysineparapente.fr or by telephone.
ARTICLE 1: DEFINITIONS
The internet platform offers an online catalog describing all the services offered by MATHEYSINE PARAPENTE. MATHEYSINE PARAPENTE reserves the right to supplement the present online catalog or to cease its distribution at its sole discretion and at any time.
- PARTIES: refers to the Client and/or the company MATHEYSINE PARAPENTE.
- CLIENT: refers to the purchaser of an activity; the Client may or may not be the beneficiary of the service depending on whether they make personal use of it or not.
- USER: refers to the person connecting to the site, without necessarily being a Client or a beneficiary.
- SERVICE: refers to the service provided by MATHEYSINE PARAPENTE to the beneficiary from the selection of offers contained in its catalog, it being understood that the execution conditions of this service depend on availability on the date chosen by the beneficiary.
- GIFT VOUCHER: refers to a voucher (digital or otherwise) purchased online allowing its beneficiary to book a Service later, under the conditions defined in these GTC.
- PERSONAL DATA: refers to any information used, particularly on the internet, to identify a natural person (surname, first name, email address).

ARTICLE 2: PURPOSE OF THE CONTRACT AND APPLICABILITY OF THE GENERAL TERMS AND CONDITIONS OF SALE
2.1 Purpose of the contract
The purpose of these general terms and conditions of sale is to define the conditions and modalities surrounding the marketing by the company MATHEYSINE PARAPENTE of its products and services.
2.2 Prior acceptance of the general terms and conditions of sale
Acceptance of the general terms and conditions of sale is essential prior to the acquisition, receipt or use of an activity on the site. The user acknowledges the general terms and conditions of sale in their entirety by clicking on the hypertext link provided for this purpose, and accepts them by checking the box provided. Failure to accept the general terms and conditions of sale according to the aforementioned modalities deprives the user of the possibility of continuing the current reservation process.
2.3 Applicability
These general terms and conditions of sale are applicable only to reservations for activities made on the site or by telephone.
2.4 Modification
MATHEYSINE PARAPENTE reserves the right to modify these general terms and conditions of sale at any time, it being understood that the modifications will be inapplicable to reservations previously accepted and confirmed.
2.5 Capacity of the client
Every Client declares they have the legal capacity to contract in accordance with Article 1124 of the Civil Code.
ARTICLE 3: FORMATION OF THE CONTRACT
3.1 Via the website
3.1.1 Reservations can be made by the user on the MATHEYSINE PARAPENTE website.
3.1.2 The user selects one or more activities offered in the online catalog.
3.1.3 A summary is then sent to the user, showing the choices made as well as the total price of the reservation, with an indication of the payment method.
3.1.4 A first click allows the user to check the details of their reservation and correct any errors before final registration.
3.1.5 The reservation is registered and the contract deemed formed only after confirmation (second click).
3.1.6 A confirmation email will be sent to the user.
3.1.7 Saving and printing the confirmation email allows the Client to provide proof of the reservation.
3.1.8 In case of payment by credit card, the contract will be deemed definitively concluded only subject to the acceptance of the payment by the client's bank. In case of payment by check, transfer, or cash, the contract will be deemed definitively concluded only upon receipt of payment.
3.2 By telephone
3.2.1 Reservations by telephone are possible during MATHEYSINE PARAPENTE's opening hours.
3.2.2 A confirmation email will be sent to the Client, showing the details and the total amount of the reservation.
ARTICLE 4: PRICE AND PAYMENT TERMS
4.1 Activity prices are indicated in euros including all taxes (TTC) and are those in force on the day of reservation.
4.2 Activities are not subject to VAT.
4.3 The user may opt for payment by credit card, transfer, bank check, or cash.
4.4 Payment by credit card can be made via Carte Bleue, Visa, Eurocard/Mastercard, Maestro.
4.5 In the case of an online purchase, the Client provides the information necessary for payment via the secure interface of the payment provider.
4.6 Payment results in the immediate debit of the total amount or a deposit of the reservation amount according to the modalities indicated at the time of order.
4.7 In case of non-payment or refusal of authorization, MATHEYSINE PARAPENTE is entitled to suspend or cancel the reservation.
4.8 In case of payment by bank check, checks must be sent to the address indicated in the confirmation email.
4.9 Checks must contain the reservation reference, failing which the reservation may be canceled.
ARTICLE 5: PROOF OF RESERVATIONS
5.1 Data recorded in the databases of MATHEYSINE PARAPENTE constitute proof of reservations made, subject to a manifest material error.
5.2 Data relating to reservations constitute accepted modes of proof and are enforceable under the same conditions as documents established in writing.
ARTICLE 6: PAYMENT SECURITY
6.1 Activity reservations may be subject to checks. MATHEYSINE PARAPENTE may suspend the process and request supporting documents (residence, identity, etc.) to combat fraud.
6.2 Information collected during these checks may be subject to automated processing to define a transaction security level.
ARTICLE 7: TRANSFER OF OWNERSHIP / TRANSFER OF RISKS
Since the services sold are service provisions, the concept of transfer of ownership does not apply. Risks related to the execution of the service (high-risk sports activity) are governed by these GTC, particularly by the articles relating to safety conditions, instructions, and the fitness of the beneficiary.
ARTICLE 8: NON-COMPLIANCE
8.1 Any error regarding the activities ordered must be reported by the Client, by letter or email (contact section of the site), within 72 hours following the date of receipt of the confirmation email.
8.2 Claims not made under the conditions stipulated in this article cannot be taken into account.
ARTICLE 9: CONDITIONS OF USE FOR ACTIVITIES / SERVICES
9.1 These GTC must be brought to the attention of the beneficiary. This transmission of information will be handled by the Client if necessary.
9.2 The possibility of benefiting from a service is subject to the prior presentation of the confirmation email and/or a valid gift voucher.
9.3 Photographs presented in the catalog are not contractual, and any partial or full reproduction is prohibited.
9.4 The delivery of the Service is subject to the specific conditions of MATHEYSINE PARAPENTE, particularly in terms of cancellation or modification of the reservation, age limits, and physical conditions of the beneficiary or beneficiaries. In any case, MATHEYSINE PARAPENTE cannot be held liable in the event of non-compliance with safety instructions, fault of the Client/Beneficiary, or in case of force majeure.
9.5 Certain conditions must be taken into consideration (weather, physical condition of participants, safety); MATHEYSINE PARAPENTE may validly refuse the execution of the service or proceed with its postponement. Paragliding is a free flight activity; practice is conditioned by meteorology and aerology. The Client is informed and acknowledges the possibility for MATHEYSINE PARAPENTE to cancel services at the last minute, notably:
- in case of unfavorable weather conditions,
- for safety reasons at the decision of a member of the MATHEYSINE PARAPENTE staff,
- due to force majeure, a pandemic, or government restrictions.
In the event of one of these events occurring, MATHEYSINE PARAPENTE will not be liable for losses suffered by the Client due to cancellations beyond its control. Services canceled for the aforementioned reasons will be refunded or postponed according to the Client's availability.
MATHEYSINE PARAPENTE will contact, as far as possible, the Client / beneficiary of the gift voucher at the number provided, to warn them of the cancellation of the service or the uncertainty of its realization following changes in weather conditions. MATHEYSINE PARAPENTE cannot be held responsible if the Client / beneficiary contacted did not answer and/or did not acknowledge the message left. It is the responsibility of Clients to ensure that their contact details are correct.
MATHEYSINE PARAPENTE reserves the right to cancel for physical or psychological incapacity of the Client for their safety. In this case, the refund will be calculated proportionally to the service not actually performed, if applicable.
9.6 The beneficiary is required, in the context of the execution of the service, to comply with the safety instructions provided by the pilot. Aware of these risks, the beneficiary declares to accept the consequences.
9.7 Delay: in case of delay at the meeting point, MATHEYSINE PARAPENTE reserves the right to shorten the flight duration, depending on the length of the delay, or to cancel the flight if the remaining time before the next meeting is insufficient to perform the Service. In both cases, the total amount of the service will be due.
9.8 MATHEYSINE PARAPENTE cannot be held responsible for any delay due to aerological conditions or the safety of the passenger or pilot.
ARTICLE 10: CUSTOMER SERVICE – COMPLAINTS
Any request for information and clarifications relating notably to purchase, refund, exchange, or operation of activities, must be sent to MATHEYSINE PARAPENTE by email or post.
ARTICLE 11: PERSONAL DATA AND COOKIES
MATHEYSINE PARAPENTE collects and processes personal data notably in the context of reservations, customer relations, and legal obligations. In accordance with the GDPR, the Client/User has rights of access, rectification, deletion, opposition, and limitation of processing.
Cookie consent management is ensured by a module compliant with current regulations: Complianz – GDPR/CCPA Cookie Consent. Details of the cookies used, their purpose, and their retention period can be consulted via the site's Cookie Policy.
ARTICLE 12: LIABILITY
12.1 MATHEYSINE PARAPENTE cannot in any case be held liable if the non-performance or poor performance of the contract is attributable to the Client, or to the unpredictable and insurmountable act of a third party unrelated to the provision of the Services, or to force majeure.
12.2 Any clause is understood subject to mandatory legal provisions applicable to the consumer.
12.3 Unless otherwise provided by law, MATHEYSINE PARAPENTE can in no case be held liable for damage caused by the Client.
ARTICLE 13: SEVERABILITY
Should one of these provisions be declared null or deemed unwritten, the validity of the other provisions will not be affected.
ARTICLE 14: INSURANCE
14.1 Independent instructors of MATHEYSINE PARAPENTE benefit from professional civil liability insurance covering damage resulting from their actions in their capacity as professionals, including search, rescue, and repatriation costs.
This insurance does not substitute for the Client's individual civil liability for damage they might cause to themselves or to third parties.
ARTICLE 15: GIFT VOUCHER
Gift vouchers offered by MATHEYSINE PARAPENTE have a validity period of twelve (12) months from the date of payment.
Gift vouchers are usable only during the activity's opening periods, i.e., from May 1st to October 15th, subject to weather conditions and availability.
At the end of the twelve (12) month validity period, the Client or the beneficiary can no longer book Services. The sums paid will then remain definitively acquired by MATHEYSINE PARAPENTE, without the possibility of refund, extension, or postponement.
It is the responsibility of the gift voucher beneficiary to contact MATHEYSINE PARAPENTE sufficiently in advance to agree on a flight date during the voucher's validity period and during the activity's opening period.
MATHEYSINE PARAPENTE cannot be held responsible for the impossibility of performing the Service if the beneficiary contacts the company late and no slot is available before the gift voucher's expiration date or before the end of the annual opening period.
ARTICLE 16: RIGHT OF WITHDRAWAL
In accordance with the provisions of Articles L221-18 and following of the Consumer Code, the consumer Client benefits from a period of fourteen (14) days from the date of purchase to exercise their right of withdrawal, without having to justify a reason or incur penalties.
The right of withdrawal applies exclusively to the purchase of gift vouchers made online on the site https://matheysineparapente.fr, provided that the gift voucher has not been used, even partially, and that no reservation has been made by the beneficiary.
In accordance with Article L221-28, 12° of the Consumer Code, the right of withdrawal does not apply to leisure services provided on a date or at a determined frequency. Consequently, any reservation of a paragliding service on a fixed date is firm and final and cannot give rise to a refund under the right of withdrawal.
To exercise their right of withdrawal, the Client must notify their decision in writing (email or post) to MATHEYSINE PARAPENTE before the expiration of the fourteen (14) day period. In case of valid exercise of the right of withdrawal, MATHEYSINE PARAPENTE will proceed with the refund of sums paid within a maximum period of fourteen (14) days from receipt of the request, using the same payment method as that used during purchase, unless expressly agreed by the Client for the use of another method.
ARTICLE 17: APPLICABLE LAW
The law applicable to these GTC and to the contract concluded on the occasion of an activity reservation is French law.
ARTICLE 18: DISPUTE RESOLUTION / COMPETENT JURISDICTION
This contract is subject to French law. In the event of a dispute, the consumer Client may seize the competent jurisdiction in accordance with mandatory legal provisions. Failing that, the court of Grenoble will be competent.
General Terms of Use (GTU)
ARTICLE 1 – PURPOSE
The purpose of these General Terms of Use (hereinafter "GTU") is to define the modalities of access and use of the site https://matheysineparapente.fr (hereinafter the "Site"), published by MATHEYSINE PARAPENTE.
ARTICLE 2 – IDENTITY OF THE PUBLISHER
